You find your way at the intersection of faith and the culture. It’s WallBuilders Live, where we look at things from a biblical, and it’s already Christmas time. Well, maybe not for some people, I mean, it is kind of Thanksgiving coming up. But clearly David Barton has control over the music of the program today. And I did notice on our constitution class weekly, a week or two ago when Tim was on, there was a Christmas tree in the background. I think that was still October. I don’t even think we were in November yet. So welcome to the Christmas show for WallBuilders Live. I take it David, you want to start talking about Christmas already?

David:

Man, I couldn’t help but I was in the store today, they had Christmas decorations out, they were selling Christmas stuff. I look for any excuse to be able to do something with Christmas and that was all it took to set me off today. So that’s what happens. If you’re not here with adult supervision, I just go off on Christmas.

Rick:

Well, by the way, for our listeners that are longtime listeners, they know David Barton is America’s premier historian. What they didn’t know is that David Barton is America’s premier Christmas promoter, new title for you, just came up with that.

David:

I take that as a compliment.

Rick:

Well, also with us is Tim Barton, national speaker, Pastor, and president of WallBuilders. My name is Rick Green, I’m a former Texas legislator, and America’s Constitution coach. And the three of us have been bringing you election results for two weeks now, two weeks, and I guess, two weeks, today makes two weeks that would be the day after the election. And now two weeks later, the day after two weeks has passed. Anyway, it’s still going, and rightfully so.

Guys, as we’ve said, many times on the program is we’ve encouraged people to recognize it’s important to have this kind of process so you can have faith in elections. In order to do that, you got to have transparency, you got to have verification, that’s what’s happening right now, and you got to have legal remedies when there’s been violations of the process. So we’re encouraging everybody to be patient and let this process play out. And we’ll try to bring up to date information as often as possible on our program. So let’s jump into that. Even in the last 24 hours more movement on many fronts. David, I think you were looking at, was it Pennsylvania that you want to talk about first?

David:

Let’s start with Nevada. Yeah, there’s some interesting things going on in Clark County. Clark County is the Las Vegas area, so that’s the big voting area of the state. And so in addition to all this being counted with the presidential election, which is where much of the nation is looking, they’ve also got their local races going there.

And one of their local races was with a commissioner there, we would call them a county commissioner in Texas, but it’s a commissioner over district C. And so a district C commissioner, that represents about one-sixth of Los Vegas, so it is a large area, there were 153,000 votes cast in that district C area. So you would also expect that they would have voted for president as well.

And so as the count has gone along, there are two Democrats running against each other. And these two Democrats running against each other, there’s a razor thin margin of only 10 votes between these two guys with 153,000 votes counted. Well, what happens is they have found about 936 voting discrepancies in that race. And there’s 130 some odd up, I think, 139 that they can’t explain that they don’t know why it did what it did, or whatever. And so it’s enough that they’re calling for a reelection or a new election is a better way to say it in that race.

And so with that, it’s alright, there’s an acknowledgement the system didn’t work well. There were enough mistakes in that system to actually sway the election one way or the other, so they’re going to have to go back and do a new election and make sure that there’s not those kinds of discrepancies in there.

Now, that’s a Democrat on Democrat kind of election, but it is that is essentially saying that alright, this one-sixth of the votes here, there’s problems with them. And so you can understand why President Trump tweeted, he said this is big victory moments ago in the state of Nevada. They’re all Democrat county commissioner race on same ballot as president just thrown out because of large scale voter discrepancy. So it’s like he’s saying, this is what I’ve been telling you about. There’s some voting problems here in this area. And Nevada certainly is one of the several states in which there’s legal action going on which they expect to have more. But just the results today in Nevada, President Trump took to say, yeah, that’s what I’ve been telling you. There’s some stuff going on there and there was enough discrepancy, even that Democrat election to sway the outcome, so they’re having to have a new election.

Tim:

Well, guys, also in Nevada, you have the electoral college candidates who have filed an election contest, where they’ve identified what they believe to be irregularities voter fraud in places and actually potentially, of buying what they believe to be buying ballots from Native Americans offering incentive for them to vote a certain way. And so there are other lawsuits as well being filed.

And that dad, the one you just mentioned, where it looks like there’s a victory and it could have an impact on some of those presidential ballots. This is another situation where there’s a filing, and we talked about before that a lot of the lawsuits being filed are not all being filed specifically about the Trump campaign. It could be and you would largely expect they’re working in collaboration with the Trump campaign; maybe this is a strategy to have some of the lawsuits on the ground game from different individuals close to the scenario. But the people who are the Electoral College candidates who are pledged to cast their vote for Donald Trump, they have filed an election contest under the Nevada’s election code law, citing some of these irregularities and problems. So there definitely is stuff going on still in Nevada, or I guess, Nevada…

Rick:

Nevada. Yeah, they keep correcting us out here. Tim and I are in Nevada, and we keep being taught, it’s Nevada, not Nevada.

Tim:

Yeah, I might have to work on that.

David:

Hey, by the way, did guys notice that I said it right? I tried to signal to you.

Rick:

You did and then I repeated it wrong. Hey, by the way, Tim, I like what you just talked about, because that also reminds people. An election redo is not out of the question. If it can be done in Nevada, it can be done in other places around the country as well. So David, that commissioner seat you’re saying, I mean, if they’re redoing that one, then if you find those kind of anomalies, shouldn’t you be redoing all of the races that were in that commissioners district? So I’m sure that we’re local races where you have potential anomalies below that commissioner race, and then of course, above that being the president and other races.

Tim:

Well, and guys, one thing to just looking at, again, this presidential race and what we’re seeing happen in States is in Pennsylvania, the Trump, I guess, you might say the Trump legal team there, who is really working on hitting the lawsuits of what they believe to be voter fraud and issues with election integrity in Pennsylvania, Trump is replacing, it looks like maybe all of the legal team in Pennsylvania. And then there is maybe a level of curiosity of why would he do that? Was there maybe some lack of activity or going a different direction? Not really sure. But it does seem like President Trump is finding people who really are engaged and want to fight and are going forward.

And so now in Pennsylvania, a lot of President Trump’s legal team has been switched, and there are now different suits being filed in Pennsylvania trying to block the certification of Pennsylvania’s election results. So there’s definitely more stuff going on, which is why probably every day we’ll be able to talk about some of these different results happening in States, these different lawsuits, these Judges’ rulings, all these things that are unfolding, it could be another couple of weeks seeing some of this stuff happen, and we’ll definitely try to keep you updated as we find out new information.

Rick:

Does anybody else immediately think of, let’s see who was a president that had to keep firing generals until he found one that could actually win? Oh, some Lincoln guy, right? Maybe that’s what’s happening in Pennsylvania. Trump’s having to find the right legal guys that can actually win the fight, I don’t know.

David:

Well, it’s interesting that the Trump team is making this change, because it’s right on the eve of a court hearing on all the things there in Pennsylvania. And what a strange thing to be pulling that team out and put a new team on the field, is like go line drive in the fourth quarter. But it’s interesting. The team they sent in includes Rudy Giuliani, and within the last 24 hours, Giuliani who used to be a formal federal prosecutor, so he is an attorney who is very familiar with court situations, he went to the district federal court in Pennsylvania and asked for permission to practice there in Pennsylvania, because he’s not registered as an attorney in Pennsylvania. And the court gave him permission to be able to do the case there.

So you now have Rudy Giuliani, but it’s interesting what he said and talking about what’s going on there. Giuliani said that they’re prepared to lose cases in several states and that doesn’t bother them, because what they want to do is get to the US Supreme Court. And that was the same thing that happened with the 2000 election with Bush-Gore, they lost in the State courts, it got to the US Supreme Court, and the US Supreme Court said no, you have to treat everyone the same. You can’t have a different standard for Republicans than you have for Democrats and etc.

And so he’s not concerned about whether they win or lose necessarily in State court, they just wanted to get moving toward the Supreme Court. And it’s interesting that in talking about it, Giuliani said they have lawsuits ready to go in some seven to nine states, which is interesting, because most people thought that they were going to be working in four or five states. And so they even have lawsuits ready to go in States that are not now considered battleground States, which is really interesting. It kind of say, well, I wonder what they’ve got going here? I mean, that’s a pretty strong number from Giuliani. And so I think he really signaled something interesting.

He said as part of the interview, he said, “I believe we’ve amassed more than enough evidence in Pennsylvania, Michigan, and Wisconsin, and Georgia.” He named those four states. But he said that they were also looking at other States and filing suits. So it looks like there’s a lot yet to the come. And guys, as you pointed out, this is, I guess, we can call it E plus 15 election plus 15 days later. But it’s not like that these are boring updates from day to day. I mean, there’s actual active stuff going on, and it’s not like you’re having a dig deep to the bottom of the pile. This is really breaking stuff. And it’s still going to be fun in the coming days to see what they do with their lawsuits. I think they’re holding back to do some blockbuster stuff. We’ll see. But that’s the sudden well as I’m saying, but it’s going to be interesting to see what we have in coming days.

Rick:

Yeah, David, I mean, like you’re saying, these are not small things, and it doesn’t take all of these things for this election to turn. So these are big things that are going to take some time, and that’s one reason people need to tune in every day. We’ll be talking about it Monday through Friday right here on WallBuilders Live. Alexia de Tocqueville, a political official from France, traveled to the United States in 1831 and penned his observations in the now famous book, Democracy in America. Being from France, what he found in America was completely unexpected to him. He reported, “Upon my arrival in the United States, the religious aspect of the country was the first thing that struck my attention. And the longer I stayed there, the more I perceived the great political consequences resulting from this. In France, I’d almost always seen the spirit of religion and the spirit of freedom, marching in opposite directions. But in America, I found that they were intimately united and that they reigned in common over the same country.” de Tocqueville recognized that it was biblical Christianity and the morals it produced that made America great.

Rick:

We’re back here on WallBuilders Live. Thanks for staying with us. More election coverage, and yes, Christmas music, not that early, I mean, only a few days early, which this is probably the latest in the year, David Barton’s ever started playing Christmas music. I can’t remember him playing it in July in some years. But anyway, we should have a festive spirit and have joy no matter what’s happening in the election. But there’s actually some good news out of the election in some of these states. And so we’ve already talked about Pennsylvania. Where do you guys want to go next?

Tim:

Alright, guys. Let’s go to Georgia. And one of the things we saw coming out of Georgia when it looked like the two Republicans running for Senate, actually, really there was one Republican running for senate Purdue, who had the vast majority looked, like he should have been the winner. But he was just below that 50% margin, because there were three people running in that race and so it’s going to run off. And then there was another Senate race in Georgia, kind of a special election kind of race and there were a lot of people in that election. And so the vote was spread so much between all the different candidates that if you don’t have at least 50%, then it’s going to go to a runoff. And so they take the top two candidates from this special kind of Senate election.

And so there are two Republicans now in a runoff election in Georgia. And you had some Democratic leaders, you had some different personalities, calling for people who are Democrats to move into Georgia so they can vote on what was going on. And they were different government officials from Georgia that came out and said, look, if you’re moving here just to vote, that could be a felony, that’s a problem.

Well, now, even the guy in charge of the voting system in Georgia issued a warning and I think his name is Gabriel Sterling, it looks like, issued a warning that if people are moving to the State just for the upcoming election, that it would violate election law, and they could face up to 10 years in prison, thousands of dollars of fines for what’s going on. And so Georgia is at least taking a very strong position in these runoff races. And just like we have said frequently over the last couple weeks, this is something that certainly we want to be praying about. We very much would like to see the senate remain in Republican hands so that not only is there confirmation of Judges, not only can we see more prolife things happen, but in addition to it, if Joe Biden did end up winning the presidency, then you would like to see the Senate there to maybe kind of balance and slow down, hinder, or even stop a lot of the very crazy leftist liberal policies that Joe Biden would want to do.

And so in Georgia, you’re seeing different government officials coming out pretty strongly making sure people know that they can’t come there just have an impact in the Senate race that they don’t actually live in Georgia.

David:

Yeah, that’s looking at that special election coming up, and actually looking at a continuation of the count that’s been going on in Georgia for the last several days and over the weekend. Yesterday, we talked about Floyd County how that 2,600 votes showed up, or actually, 2,600 votes were not counted in that county, and the overwhelming majority went to Donald Trump. And so it changed that the statewide total. And by the way, they’re not doing a recount, they’re only doing an audit. And that’s different from a recount. An audit is just going through and seeing if they miss some things, if there were things that should be there. They’re not looking at every ballot to see if it’s a valid ballot, they’re just looking through as an audit, and that’s what this is.

So they’re doing an audit, but they found 2,600 votes that had not been entered yesterday, and today, they found another county with 2,700 votes that had not been entered, and those 2,700 votes also went very strongly for Donald Trump. So that’s cut the margin down again. And it’s interesting, by the way, the Secretary of State there is Republican guy, but he has been taking a beating from other Republicans. We know a lot of the leaders there and they just think he has not been very strong on a lot of the election stuff. He signed a consent agreement we talked about yesterday that made it very easy for the Democrats to be able to do things with mail-in ballots that State law just didn’t set up, didn’t establish.

So he’s in a very defensive posture right now and actually is attacking President Trump and saying his President Trump’s efforts and trying to stop fraud is why he lost the election. So go figure, you know, who knows how that works? But nonetheless, still a lot of stuff happening in Georgia; including today, another county with a fairly large batch of votes that have not been counted in Georgia.

Rick:

Alright, guys. So we’ve covered Nevada, Pennsylvania, Georgia, are there any other States that had updates in the last few days?

Tim:

Well, one thing that’s certainly worth noting out of Utah, is Burgess Owens, really strong, conservative guy out of Utah. It looks like that he is now officially going to be a congressman because the opponent McAdams finally conceded. So now, Republicans have actually flipped another house representative seat with Burgess Owens in that position from Utah.

Rick:

Who’s a guy that talks about faith of the founders, talks about our… I mean, he looks like he’s going to be fantastic. Alright, cool. So good news from Utah, then we’re going to take a quick break. When we come back, I would say a little bit of bad news from some of these governors, and it just might be affecting your upcoming Thanksgiving gathering. We’re back here on WallBuilders Live. One more segment today. And we’ve got a lot of states that are actually trying to tell people how to spend their Thanksgiving. I said on the last break, this might affect your Thanksgiving. I’m hoping we’re going to end this program saying don’t let it affect your Thanksgiving. But guys, what is going on with now, not just COVID orders, but Thanksgiving orders?

David:

Yeah, you know, Rick, would we have somebody who’s kind of anti-Christmas, we call them a Grinch, what do you call someone who’s anti-Thanksgiving? I don’t know. Thanksgiving Grinch, I don’t know if that really fits. But that seems to be a lot of the governors right now. We’ve already seen in California Governor Newsom is saying, hey, you can’t have a Thanksgiving gathering more than 10 people, and by the way, that’s not even a good homeschool family. So I don’t know what… I know, alright, that’s sarcasm. Sorry, we’re homeschool family as well, but that’s just kind of the joke that goes with it.

Nonetheless, there are families certainly larger than 10 and he’s also saying and by the way, you have to keep your mask on between bites, you have to chew with your mask on and just crazy…

Rick:

In your home?

David:

In your home! In your home! Chew with your mask on in between bites. We’ve seen Illinois is doing the same thing, except he’s leaving the state for Thanksgiving to go to a different State where he can enjoy Thanksgiving. So he’s locking the state down. The mayor of Chicago, oh my gosh, she is Grinch to the 10th power over Thanksgiving. You’ve seen at Washington state with Inslee, in Pennsylvania and in New Jersey with Murphy, New Mexico. New York, Cuomo says only 10 people here. And by the way, good news out of New York is the Sheriff’s there slam his Thanksgiving restrictions, and they say they’re not going to enforce his Thanksgiving restrictions. I love the quote from one of the sheriffs. He said “I couldn’t in good faith attempt to defend it in court. So I won’t.” Good for you. Because there’s no way you’re going to win that win in court. So don’t even try to enforce it.

Now, it’s just crazy to see what’s happened here. You know, really, really wild stuff. And here comes Fauci with his comment. He says, “I recognize that America has an independent spirit. But it’s time to do what you’re told.” Oh, really? Is that what you really think? Yeah, your governor should tell you can’t have Thanksgiving. You just do what you’re told. So thank you, Tony Fauci for that. So we’re seeing this all over…

Rick:

I cannot imagine, David, that people I mean, are people going to follow this stuff? Are we become that much of a sheep nation or do you think the American spirits there enough that people are going to say not a chance, I’m not going to forego my family getting together, I’m not going to put a mask on between bites at my Thanksgiving dinner? I mean, how are people are going to respond to this?

David:

Well, it’s interesting. There’s already some pushback. Governor Polis in Colorado doing the same nonsense, you know, we’re not going to have Thanksgiving… Now, it would make sense, is still be unconstitutional. But if they put that limit on protesters, okay, no more than 10 protesters anywhere, but they’re not. It’s like targeting churches, you know, churches are not essential, but everything else is. Well, here we go with thanksgiving, ten’s the limit. Well, you’re not doing that with any other store, you’re not doing that the restaurant, you’re only doing that with thanksgiving and with families. Are you kidding me? So here comes Polis…

Rick:

What if they said, we recommend it not that they say, you know, for the government to say you’re required to do this in your own home, I mean, that’s got to be rubbing Americans is wrong as much as it does us.

David:

Yeah. It’s really crazy, Rick, but it’s interesting to say that no, we’re not all going to submit and a good example, comes from a state legislator in Colorado who responded to what Polis ordered there for the State.

Tim:

Yeah, guys, actually, let me point out that one of the things Representative Bailey from Colorado, put out a statement, really solid statement. But one of the things worth noting is that just to clear up any confusion right now, yes, you should meet with your family at Thanksgiving. Now, if there’s somebody that is in a category that might be endangered, and you’re thinking, man, I don’t want my grandparents, whatever else to be endangered. Like, obviously, if you want to take cautions, be wise, take precautious, right? We’re not encouraging any level of foolishness or whatever the case might be.

But with that being said, one of the things that Representative Bailey said out of Colorado that’s so practical and important, but let me read you part of his statement. He said, “It is important for Americans to realize that in spite of their good intentions, neither a governor, a president elect nor I, as your State Representative, have the constitutional authority to restrict the number of family members who gather in your home. You have a constitutionally guaranteed right of assembly and association, specifically protected in the First Amendment. And for many Coloradoans, Thanksgiving is also a religious holiday, a time to gather with family and thank God for His blessings. And your right to the free exercise of religion is similarly protected by the First Amendment. America has been through many other tough times in medical epidemics, smallpox, yellow fever, Spanish flu, cholera and so forth, and the Constitution is not suspended because of a pandemic.”

And this is where we would point out that you know what, if you want to, in and of yourself, exercise caution. Rick, as you mentioned, it makes sense of if elected officials might say, hey, we want to encourage you to exercise caution, be safe, be careful, here’s what we recommend. But they don’t have the constitutional authority to prohibit our right to peaceably assemble or in many cases, like representative Bailey said, this is a religious holiday, and it really should be.

For those of you that are listening right now, especially if we are Christians, we want to make sure that we always take time to thank God for what he’s done. That’s part of what Thanksgiving should be, part of our free exercise of religion. Therefore, not only is constitutionally protected from the freedom of association, or maybe even the freedom of speech, but also the free exercise of religion. These are things that the President-Elect, right meaning Joe Biden or no Governor, no State Representative, Congressmen, Senator, nobody can infringe that constitutional right at this point. And so if you want to exercise caution, by all means, exercise caution. But the government doesn’t have the constitutional authority to tell us what we can and can’t do with thanksgiving.

David:

And you know, what Tim just said is exactly right. Use your personal choice to say you know, we are going to have our official Thanksgiving and less than 10, we’re all going to wear masks. If that’s your choice, great! But the government doesn’t tell you to do that. And here’s a great quote from the US Supreme Court back after the Civil War, everything had been disrupted by the war and they said the same thing. The war, it may be disruptive, but you still have the constitution to keep your rights. It says “The constitution United States is a law for rulers and people equally in war and peace, and it covers with the shield of protection all classes of men at all times under all circumstances. No doctrine involving more malicious consequences was ever invented by the will of man than to say that any of these constitutional provisions can be suspended during any the great emergencies of government. Such a doctrine leads directly to anarchy or despotism.” Amen. And that’s exactly why the constitution still in place today, it doesn’t go away just because there’s an emergency.

Rick:

Well, it sure feels like some despotism being attempted all over the country and guys, civic ignorance got us into this mess. Civic literacy is what we need.
